Có đòi được tiền đã chuyển nhầm tài khoản?

Câu hỏi: Quý luật sư cho tôi hỏi là tôi chuyển tiền cho một ngưởi nhưng do nhầm lẫn tôi gửi nhầm vào cố tài khoản của người khác. Người này đã rút hết tiền ra khỏi tài khoản vậy tôi có đòi được số tiền chuyển nhầm hay không, và phải làm thế nào?  Trân trọng cảm ơn

Trả lời: Về vấn đề bạn hỏi chúng tôi xin trả lời như sau: Về cơ sở pháp lý thì hoạt động thanh toán, quyết toán bằng đồng Việt Nam qua Hệ thống thanh toán điện tử liên ngân hàng giữa các tổ chức, cá nhân tham gia hệ thống này hiện được thực hiện theo quy định tại Thông tư số 23/2010/TT-NHNN ngày 09/11/2010. 

Khoản 4 Điều 6 Thông tư số 23/2010/TT-NHNN  quy định phương thức xử lý trường hợp tổ chức, cá nhân chuyển tiền nhầm vào tài khoản người khác như sau:

“Đối với Lệnh thanh toán sai địa chỉ khách hàng (Lệnh thanh toán chuyển đúng đơn vị nhận lệnh nhưng không có người nhận lệnh hoặc người nhận lệnh mở tài khoản ở Ngân hàng khác), sai tên, số hiệu tài khoản của người nhận Lệnh thanh toán (đúng tên nhưng sai số hiệu tài khoản hoặc ngược lại), ký hiệu chứng từ, ký hiệu loại nghiệp vụ, xử lý như sau:

a) Đối với các Lệnh thanh toán Có (hoặc Nợ) đơn vị nhận lệnh đã nhận nhưng chưa hạch toán thì thực hiện hạch toán vào tài khoản phải trả (phải thu) sau đó lập Lệnh thanh toán chuyển trả lại đơn vị khởi tạo lệnh. Nghiêm cấm đơn vị nhận lệnh chuyển tiền tiếp;

b) Đối với các Lệnh thanh toán đã thực hiện, đơn vị nhận lệnh xử lý tương tự như đã nêu tại Điểm b Khoản 3 Điều này.”

Trong tình huống của bạn, do Lệnh thanh toán đã thực hiện và người thụ hưởng đã rút tiền khỏi tài khoản thì được xử lý theo quy định tại điểm b khoản 3 Điều 36 Thông tư này, cụ thể như sau.

- Trường hợp tài khoản của khách hàng có đủ số dư: ngân hàng căn cứ vào yêu cầu hoàn trả Lệnh thanh toán để chuyển trả lại số tiền chuyển thừa:

- Trường hợp tài khoản của khách hàng không đủ số dư để thu hồi thì ngân hàng nơi có tài khoản nhận ghi nhập Sổ theo dõi Yêu cầu hoàn trả Lệnh thanh toán chưa được thực hiện và yêu cầu khách hàng nộp tiền vào tài khoản để thực hiện Yêu cầu hoàn trả này. Khi khách hàng nộp đủ tiền, ngân hàng thực hiện chuyển trả lại số tiền chuyển thừa như trường hợp trên.

- Trường hợp khách hàng không còn khả năng thanh toán hoặc khách hàng vãng lai không xác định được nơi cư trú, thì ngân hàng nơi có tài khoản nhận phải phối hợp với chính quyền địa phương và các cơ quan bảo vệ pháp luật như công an, tòa án, v.v… để tìm mọi biện pháp thu hồi lại tiền. Sau khi đã áp dụng mọi biện pháp thu hồi mà không thu hồi được hoặc không thu hồi đủ thì ngân hàng được từ chối Yêu cầu hoàn trả Lệnh thanh toán; Lập Thông báo từ chối, ghi rõ lý do từ chối kèm theo số tiền thu hồi được (nếu có); gửi trả lại ngân hàng nơi có tài khoản chuyển tiền đồng thời ghi xuất sổ theo dõi Yêu cầu hoàn trả Lệnh thanh toán chưa được thực hiện.

Để thực hiện việc đòi lại tiền thì khi phát hiện đã chuyển tiền nhầm vào tài khoản người khác, bạn phải thông báo ngay cho ngân hàng nơi bạn chuyển tiền để có cách xử lý kịp thời, thích hợp.
